General Terms and Conditions of Sale

ARTICLE 1 - FIELDS OF APPLICATION

All our sales are governed by these general terms and conditions of sale which prevail over any purchase conditions, unless expressly stipulated otherwise.

ARTICLE 2 - ORDERS

2-1 Placing and preparing the order.

The order is placed online via our website www.chateaudesboccards.com or via our reseller network (e.g. Groupon, Cdiscount...).

Once the order is received, it becomes irrevocable.

The customer specifies the method of payment (bank card or check).

The customer receives an email confirming their order.

2-2 Product unavailability

The seller undertakes to fulfill this order subject to stock availability. If the product is out of stock, the seller will offer the customer a product of equivalent quality and price. If no agreement is reached, and if the customer cancels the order, a refund will be issued in accordance with Article L 121-20-1 of the French Consumer Code.

2-3 Right of withdrawal

In accordance with Article L121-20 of the French Consumer Code, the customer has a period of fourteen clear days to exercise their right of withdrawal without having to give reasons or pay penalties, with the exception, where applicable, of return shipping costs. This period begins upon receipt of the goods.

ARTICLE 3 - DELIVERIES

3-1 Method and delivery times

Parcels are delivered by Colissimo (up to 3 bottles) or by carrier to the address indicated when ordering.

(Details about the service: We inform the customer that the Colissimo service allows for the delivery of products throughout mainland France within 48 to 72 hours from the date of dispatch. Delivery times are provided for informational purposes only and are not guaranteed.)

For international shipments, delivery times vary depending on the destination country.

3-2 Delivery Address

In the event of a change of address, the recipient of the package must inform the company GFA du Château des Boccards at least two days before sending.

3-3 Delivery Delay

We commit to delivering your order within ten business days. If delivery is not made within this timeframe, the seller will refund the order in accordance with Article L 121-20-1 of the French Consumer Code.

Optional Article 3-4 – Geographical delivery area

The delivery area for products sold on this website includes mainland France. For all other geographical areas, please contact us.

3-5 Risks

The transfer of risk for products sold by our company takes place upon delivery of the products to the carrier.

3-6 Transport

In the event of damage to or missing items of the delivered goods, the recipient must make all necessary reservations with the carrier by registered letter with acknowledgment of receipt within 3 days of receipt, in accordance with Article L.133-3 of the French Commercial Code. A copy must be sent to us simultaneously.

Any product for which no reservations have been made will be considered accepted by the beneficiary and will release our company from any liability towards the beneficiary.

Optional 3-7 Product storage

For optimal product preservation, it is recommended to store the bottles lying down, in a dry and temperate place, preferably at a temperature below 13° Celsius and especially away from light.

ARTICLE 4 - PRICE

Our prices are quoted inclusive of all taxes in euros and are those in effect at the time the order is registered.

For shipments within France, shipping costs related to the type of carrier chosen are added to the price.

For other countries, shipping costs are charged according to the destination country.

Unless otherwise agreed between the parties, payment is due upon ordering. No discount will be granted for early payment. In accordance with legal provisions, any payment made after the due date indicated on the invoice will incur late payment penalties equal to three times the legal interest rate. These penalties are payable without prior notice. Furthermore, all collection costs will be borne by the buyer.

ARTICLE 5 - PAYMENT TERMS

The price is payable immediately and in full upon ordering, according to the following terms:

— by credit card on our website (secure payment);

— or by bank check in euros to the account of the GFA du Chateau des Boccards, whose details will be specified at the time of ordering.

The order is confirmed after payment has been received.

ARTICLE 6 – RETENTION OF TITLE

In accordance with Article L 624-16 of the Commercial Code, the goods remain our property until full payment is received.

ARTICLE 7 - DISPUTES

Our company elects domicile at its registered office.

Contract concluded by a French consumer from France: the contract is subject to French law.

Jurisdiction is expressly conferred upon the High Court of the seller's jurisdiction.

Contract concluded by a consumer placing an order from another European Union country: the contract is subject to French law. Disputes are brought before the competent court in accordance with European Union rules, and in particular the Brussels Convention of 27 September 1968.

ARTICLE 8 - WAIVER

The fact that our company does not invoke any of the clauses herein at any given time shall not constitute a waiver of its right to invoke those same clauses at a later date.

ARTICLE 9 - PROTECTION OF PERSONAL DATA

Pursuant to Article 27 of Law No. 78-17 of 6 January 1978 "Informatique et Libertés", the customer has the right to access, rectify, modify and delete data concerning him/her.

ARTICLE 10 - ARCHIVING AND EVIDENCE

The data stored in the company's database constitutes proof of orders placed, except in cases of manifest error which the customer must demonstrate. Since the customer has the opportunity to verify the accuracy of the contact information entered, they alone will bear the consequences of non-receipt or loss of ordered products in the event of an error.

ARTICLE 11 – INTELLECTUAL PROPERTY

All elements of the site are and remain the exclusive intellectual property of the seller. No one is authorized to reproduce, exploit, redistribute, or use in any way whatsoever, even partially, any elements of the site, whether visual or audio.

Any simple or hypertext link is strictly prohibited without the express written consent of the seller.

ARTICLE 12 – CLAIM

ARTICLE 13 – WARRANTY AND LIABILITY

All products supplied by the seller benefit from the legal guarantee provided for in Articles 1641 et seq. of the Civil Code.

In the event of a product defect, the customer must comply with the conditions of Article 1648 of the Civil Code.

In the online sales process, the seller is only bound by an obligation of means. Thus, they can be relieved of all or part of their liability by providing proof that the non-performance or poor performance of the contract is attributable either to the customer, to an unforeseeable and insurmountable act of a third party to the contract, or to a case of force majeure.

ARTICLE 14 - PROTECTION OF MINORS

In accordance with Article L.3342-1 of the Public Health Code, which states that the sale of alcohol to minors under the age of 18 is prohibited, the customer and the beneficiary undertake to be eighteen years of age or older on the date of the order.
